  1. Scope

This license applies to designs, CAD files, 3D models, STL files, STEP files, drawings, plans, documentation, Maker’s Guides, Theory of Operation documents, software, source code, compiled software, firmware, DSP programs, DSP parameter files, measurement files, photographs, illustrations, images, data, and other materials made available by Peter Bouvier through adhocspeakers.com, collectively referred to in this license as the “Materials.”

  1. Personal, Noncommercial License

Peter Bouvier grants you a limited, nonexclusive, nontransferable license to use the Materials for your own personal and noncommercial purposes.

This permission includes:

• studying and evaluating the Materials;

• printing or fabricating parts for your own use;

• constructing loudspeakers, electronics, stands, enclosures, accessories, or other equipment described by the Materials for your own use;

• installing and using supplied software, firmware, and DSP files for your own equipment; and

• modifying the Materials for your own personal, noncommercial use.

  1. Commercial Use

Commercial use of the Materials requires prior written permission from Peter Mark Bouvier.

Without such permission, you may not use the Materials, in whole or in part, to:

• manufacture or fabricate products or components for sale;

• manufacture or fabricate products or components for another person or organization for compensation;

• sell, offer for sale, rent, license, or otherwise commercially distribute products derived from the Materials;

• operate a paid 3D-printing, fabrication, machining, assembly, engineering, consulting, or manufacturing service using the Materials;

• sell or commercially distribute CAD files, 3D-print files;

• sell or commercially distribute modified versions or derivative versions of the supplied Materials;

• incorporate the Materials into a commercial product, commercial kit, commercial publication, commercial file collection, subscription service, or manufacturing process;

• use the Materials for commercial production, whether the resulting product is sold under the adhoc name or another name; or

• otherwise exploit the Materials for commercial advantage or monetary compensation.

  1. Copies and Distribution

You may make copies of the Materials as reasonably necessary for your own permitted use.

You may not publish, upload, redistribute, mirror, sublicense, resell, or make the Materials available to third parties except with prior written permission from adhocspeakers.com.

A person wishing to use the Materials should obtain them directly from adhocspeakers.com and accept the applicable license terms.

  1. Modifications

You may modify the Materials for your personal, noncommercial use.

Modification of the Materials does not remove the restrictions of this license. A modified CAD file, drawing, software file, DSP file, document, or other work derived from the supplied Materials remains subject to the applicable restrictions of this license to the extent permitted by law.

  1. Intellectual Property

The Materials remain the intellectual property of their respective owner.

This license grants permission to use the Materials only as expressly stated. It does not transfer ownership of any copyright, patent, trademark, trade name, design right, or other intellectual-property right.

Certain products, structures, methods, and designs described by the Materials may be associated with U.S. Patent 7,925,036 B2 and related intellectual-property rights.

Nothing in this license grants a patent license or authorization to practice any enforceable patent claim except where expressly granted in a separate written agreement.

  1. Attribution and Marks

The names “adhoc,” “adhocspeakers.com,” “Flow/1,” “Flow/2,” and associated names, logos, graphics, and product identifiers may be subject to trademark, copyright, or other rights.

This license does not grant permission to represent a product, business, service, or modified design as being produced, approved, certified, or endorsed by Peter Bouvier or adhocspeakers.com.

  1. No Commercial License by Purchase or Subscription

Payment for website membership, subscription access, downloadable Materials, or other access to adhocspeakers.com does not grant commercial manufacturing, resale, redistribution, or sublicensing rights.

Any commercial license must be granted separately and expressly in writing.

  1. Termination

Your rights under this license terminate if you materially violate its terms.

Following termination, you must cease any use of the Materials that depended upon the license granted here. Intellectual-property rights and obligations that by their nature continue after termination remain unaffected.

  1. No Warranty

The Materials are provided “as is.”

To the maximum extent permitted by applicable law, Peter Bouvier and adhocspeakers.com make no warranty concerning the suitability, performance, safety, accuracy, reliability, merchantability, or fitness of the Materials for any particular purpose.

Construction and use of loudspeakers, electronics, electrical equipment, fabricated parts, tools, and related equipment involve risks. You are responsible for determining whether the Materials and any resulting construction are suitable and safe for your intended use.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, Peter Bouvier and adhocspeakers.com will not be liable for losses, damages, injuries, costs, or claims arising from the use, modification, fabrication, assembly, installation, or operation of the Materials or products made from them.

  1. Commercial Licensing

Commercial licenses may be available for manufacturing, fabrication, resale, publication, incorporation into other products, or other commercial uses.

Commercial permission must be obtained in writing before such use begins.
